LONDON, England (AP) — A British man who allegedly took Viagra to treat his erectile dysfunction was sentenced today to five years of probation and ordered to pay a criminal fine of £2.5 million.
David R. James, 55, was convicted of illegally marketing and selling counterfeit or expired prescription drugs in the United States and Europe after he sold Viagra and Cialis to a doctor in 2012. In April, he pleaded guilty to importing and trafficking in counterfeit prescription drugs and selling them in violation of 21 U. S. C. § 331.
Ruth E. Coughlin, 57, was sentenced to two years probation and ordered to pay a criminal fine of £2.5 million.
James faces up to 10 years in federal prison.
The U. District Court for the District of Delaware announced his release today.
The federal government is paying $6.5 million to the federal government’s Office of Criminal Investigations and the U. Food and Drug Administration.
James, the father of four, has pleaded not guilty to a charge of importing, trafficking in and selling counterfeit prescription drugs.
He faces up to 10 years in federal prison for the crimes.
According to a court filing, he and his co-conspirator, Thomas L. Stearns, were operating a drug business while he was in high school in the United States and were involved in the illegal sale of prescription drugs.
Stearns, who worked as a sales representative for Pfizer Inc. in the United States, sold more than 30 million counterfeit and expired prescription drugs, including Viagra, Cialis and sildenafil citrate.
The company, which called itself "Canadian," offered to sell Pfizer products under the name "Viagra."
The company did not respond to a request for comment.
James, who also pleaded guilty, was sentenced to eight years of probation and ordered to pay a criminal fine of $2.5 million.
A federal witness, John J. Mankin, a U. attorney, testified that in May 2012, he contacted the FBI, which investigated the sale of counterfeit Viagra and Cialis to U. citizens. He said he received information from the FBI regarding the sale of the fake pills and the alleged illegal marketing of these drugs.
The government did not respond to a request for comment.
James, who sold the counterfeit prescription drugs to doctors and pharmacists in the United States, received a three-month prison sentence.
The case is being prosecuted by Assistant U. Attorney James A. Koppel. Assistant U. Attorney Kenneth C. Schondel is prosecuting the case.
